The revision petitioner herein is the first accused in CC.No.68/2004 before the Judicial First Class Magistrate Court-I, Aluva. He challenges the conviction and sentence under Sections 341 and 323 IPC, Of course the second accused was found guilty under Section 326 IPC also. Pending the proceedings the parties amicably settled the whole disputes including the civil dispute. Accordingly the revision petitioner filed Crl.MA.No.2788/2014 to close the proceedings as against the revision petitioner in view of the amicable settlement arrived at out of court. The de facto complaint also filed Crl.MA.No.2728/2014 with a prayer to quash the proceedings in view of the amicable settlement. On hearing both sides I find that the parties have amicably settled the whole disputes out of Court, and have compounded the offences under Sections 341 & 323 IPC.

2 Accordingly Crl.MA.No.2728/2014 is treated as composition, and permission is granted for composition under Section 320(6) Crl.PC.
2. In view of composition the conviction and sentence against the revision petitioner herein under Sections 341 and 323 IPC in CC.No.68/2004 of the Judicial First Class Magistrate Court-I, Aluva are set aside, and the revision petitioner is released from prosecution on the benefit of acquittal under Section 320(8) Cr.PC.
This revision is allowed as above.
