What is under challenge in this proceeding is an interim maintenance order passed by the Family Court under Section 125 of the Code of Criminal Procedure in a maintenance claim brought as M.C No.277/2012. Now the learned counsel for the petitioner submits that conciliation efforts are going on, and that the main proceeding itself is ripe for trial and disposal. Whatever amount awarded as interim maintenance will definitely be adjusted towards the amount due when the main proceeding is finally decided. Anyway, in the present circumstance, where the main claim itself is ripe for trial and disposal, and also when efforts are going for amicable settlement, this proceeding need not continue.
Accepting the submission made by the learned counsel, this Original Petition is closed.
