THIS PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT PASSED THE FOLLOWING;
O R D E R In this petition, the petitioner is seeking for a writ of mandamus to consider the appeal and application filed by him at Annexures – J and K.
2. When the matter was taken up today, learned counsel for the petitioner submitted that the appeal and application filed by the petitioner shall be considered. On the other hand, AGA for the respondents submitted that the same shall be dealt with in accordance with law if not already decided.
3. In view of the submissions made and in the facts of the case, I deem it appropriate to dispose of the writ petition with a direction to the 2nd respondent to decide the appeal of the petitioner as expeditiously as possible by a speaking order, by affording opportunity to the parties, within a period of six weeks from the date of receipt of certified copy of the order passed today. It is made clear that this Court has not expressed any opinion on the merits.
Accordingly, the petition is disposed of.
The interim order granted on earlier occasion by the Bench of this Court shall continue till the appeal is decided by respondent No.2.
