JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) 1. Though this matter is notified for admission hearing, with the consent of learned counsel for the parties, the matter is taken up for final hearing today itself.
2. We have heard Mr. Dipen Desai, learned counsel appearing for the petitioner and Mr. P.C. Kavina, learned Senior Counsel assisted by Mr. Biren Vaishnav, learned counsel appearing for the respondents.
3. Learned Senior Counsel Mr. Kavina has informed the Court that some decision has been taken by the Chief Electoral Officer, Gujarat State on 14.10.2012 and in light of that instructions, the claim of the petitioner would be examined and if there is only one vehicle in the control of the petitioner APMC, then the respondents shall consider as to whether the sole vehicle should be requisitioned or not looking to the hardship to be faced by the petitioner. Learned counsel for the petitioner Mr. Dipen Desai has submitted that in the petitioner Market Committee, there is only one vehicle.
4. In this regard, the petitioner shall make a fresh representation before the respondent No.2 within a period of 3 days from today. In case, such a representation is made, the same shall be decided by the respondent No.2 within a further period of one week in accordance with law by a reasoned speaking order.
5. With the aforesaid directions, this petition stands finally disposed of. Direct service today is permitted.
