The petitioner is granted permit to remove granite building stone from an area of 0.7688 hectares in Survey Nos.1854 and 1855 of Pazhayannur Village of Thalappilly Taluk in Thrissur District. The number of 'P' form to be issued is restricted as the date of expiry of permit is 9.2.2015. The petitioner submits that the Geologist is bound to issue one year short term permit and restricting the validity of the permit upto 9.2.2015 is illegal. It is challenging the restriction of validity of permit, this writ petition is filed.

The learned Government Pleader, on instructions, submits that it is only to have supervision of mining activities, permit is restricted upto 9.2.2015 and definitely, if so warranted, it will be renewed in accordance with law. If the petitioner is unable to extract and remove the granite WP(C).No.28325/2014-M.
2 building stone from the mining area, I am of the view the permit granted to the petitioner shall be renewed so as to remove granite building stone from the area mentioned in Ext.P1. Therefore, the petitioner shall apply for renewal of permit, two weeks before expiry and if it is satisfied that the petitioner is unable to extract and remove granite building stone from the entire area mentioned in Ext.P1, necessarily the permit shall be renewed for a further period.
Writ petition is disposed of as above.
