It has been stated by Sri Sudhir Mehrotra, learned Additional Government Advocate, that in the First Information Report lodged against the petitioner charge sheet has been filed and the concerned Magistrate has taken congnizance on 13.6.2007. The trial is going on. The petitioner has not challenged the lodging of First Information Report nor has sought quashing of the charge sheet in the present proceedings. However, he wants that the investigation be started against the respondent no.2 for lodging a false First Information Report under Section 182 Cr.P.C. Sri Mehrotra submitted that the police authorities would further investigate the matter and do the needful in view of the subsequent recovery of the official file.
The writ petition lacks merit. It is dismissed.
