Leaned advocate for the petitioner submits that the revisional Court erred in reversing the findings of facts about Nikhanama and Nikha itself of the petitioner with respondent No.2 and further the re appreciation of evidence recorded by learned Magistrate in accordance with law is reconsidered by assigning absurd reasons.

In view of the above, notice returnable on 21.2.2012. Learned APP, waives service of notice for respondent No.1.

Meanwhile, ad-interim relief in terms of para 20(B) is granted.

Direct service for respondent No.2.
