Chitambaresh, J.
The suit is one for specific performance of Ext.A1 agreement for sale dated 21.09.1992 executed between the plaintiff on the one part and defendants 1 to 5 on the other part. The defendants agreed thereunder to sell the property belonging to the first defendant to the plaintiff at the rate of `25,000/- per cent. The defendants contended that they were under the impression that the property is being sold at the rate of `50,000/- per cent. The plea in essence is that Ext.A1 agreement is fraudulent and not valid in the eye of law and that the same is not specifically enforceable as sought.
