This appeal is from the judgment and decree in LAR No.56/1998 on the file of the III Additional Sub Court, Ernakulam.
2. The appellant is the requisitioning authority and the land was acquired for the purpose of Export Promotion Industrial Park. The notification under Section 4(1) was published in the gazette on 31.01.1995 and the land value awarded by the Land Acquisition Officer is at the rate of Rs.3,830/- per are which stands enhanced to Rs.5,745/- per are by the reference court.
3. We heard the learned counsel on both sides.
4. The ground taken in the appeal is that the reference court had referred to the judgment in LAR No.47/1997 even though the appeal was pending. It is also contended that the land value has been enhanced by guess L.A.A.No.503 of 2001 -2- work alone.
5. Presently the judgement in LAR No.47/1997 and other case have been modified by this court in LAA No.563/2000 and connected cases and the land value re- fixed is Rs.21,000/- per are. In this case the category of the property acquired is high lying wetland viz. category No.9. In similar cases we have affirmed the value fixed by the reference court at Rs.13,600/- per are in LAA No.198/2006 and connected cases. Herein the value awarded by the reference court is much less than the same. Apart from the same the property was lying only 1 = k.ms. away from the civil station and it was a developing locality also. For all these reasons, we confirm the judgment and the appeal is dismissed.
