This appeal is filed by some of the defendants in O.S.No.70 of 1989 on the file of the Sub Court, Hosdrug, aggrieved by the judgment and decree passed on 26.09.1998. By order dated 30.09.2015, this appeal was referred for mediation at the District Mediation Centre, Kasaragod. Accordingly, the dispute was mediated and the parties have settled their disputes. Incorporating the terms of settlement, they have entered into a memorandum of agreement dated 15.02.2016. In the light of the settlement thus arrived at, this appeal is disposed of directing that the terms of settlement incorporated in the memorandum of agreement dated 15.02.2016 and the plan attached thereto will form part of the decree in the appeal.
All pending interlocutory applications will stand closed.
