Ramachandran Nair, J., In this appeal, the claimants seek further enhancement of the land value. The appeal is from the judgment of the reference court in L.A.R. No. 496/1993. Herein, the notification under Section 4 (1) was dated 30.12.1989 and the land was acquired for the purpose of the requisitioning authority viz., NTPC. The Land Acquisition Officer awarded land value at the rate of Rs. 2,200/- per Are, being wet land which was enhanced by 100% i.e. Rs. 4,400/- by the reference court. Before us, the learned counsel for the appellants submitted that Ext.A2 judgment, relied on by the claimant stands confirmed in L.A.A.707/2000. The above appeal was filed by the requisitioning authority itself. Going by the same, the land value fixed by this Court is Rs.6,400/- per Are.
2. In that view of the matter, we will be justified in L.A.A.No.1347 OF 2002 :2: adopting the same land value as acquisition is for the same purpose and properties are similarly categorised. The appeal is allowed and the land value for the acquired property is fixed at Rs. 6,400/- per Are. The appellants will be entitled to all the statutory benefits as granted by the trial court. No costs.
