Heard learned counsel for the applicant and learned A.G.A. for the State.
This application under section 482 Cr.P.c. has been filed to quash the order dated 4.10.2018 passed by Principal Judge, Family Court, Maharajganj in case no. 2103 of 2014(Smt. Nahid Khan Vs. Afzal) under section 125 Cr.P.C. P.S. Kolhui District Maharajganj, pending in the court Principal Judge, Family Court. Maharajganj and directed the Principal Judge, Family Court, Maharajganj for provding one opportunity for cross examination of D.W.2.
The argument is that by the impugned order dated 4.10.2018 opportunity of cross examination of opposite party/applicant has been closed by the Principal Judge, Family Court, Maharajganj.
In case applicant deposits Rs.5,000/- payable to the opposite No. 2, he will be granted one opportunity to cross-examine the witness concerned.
With the aforesaid direction, the application is disposed of.
