Heard Mr. Ashutosh Kumar Pandey, learned counsel for the applicants and the learned A.G.A. for the State.
The present application under Section 482 Cr.P.C. has been filed after an expiry of period more than two years from the date of passing of the summoning order dated 11.4.2016. The laches in filing the present application have not been sufficiently explained in paragraphs 21, 22 and 23 of the affidavit. Consequently, learned counsel for the applicants submits that he be permitted to withdraw the present application with liberty to file a fresh with better particulars and details regarding the laches in filing the present application.
Prayer made is allowed.
The application is, accordingly, dismissed as not pressed with liberty to file a fresh with better particulars and details.
Certified copy of the impugned order may be returned to the learned counsel for the applicants after obtaining photo copy of the same to be kept on record.
