This writ petition is field by the petitioners with a prayer to issue a writ of mandamus commanding the respondent no.1 to 4 to decide the petitioner's representation allegedly filed on 19.07.1999 and 05.07.2000. The petitioners further prayed for writ of certiorari quashing the order dated 24.05.1998 (Annexure 2).
Admittedly, there is no interim order passed by this Court as such the counsel representing the petitioners prayed for and was granted two weeks time to file supplementary affidavit annexing the copy of the appointment letters.
A supplementary affidavit filed on 31.10.2001 is available on record and annexure SA-1 is a typed copy of the alleged letter of appointment which clearly indicats that one Sri Aftab Husain was appointed in the Madarsa, Islamia Jamayatul Quraish, Jalandhari, Azamgarh by the order issued by the Manager of the said Madarsa.
No counter affidavit is filed by the respondent nos.1, 2, 3 and 5, 6, 7 and 8. The order impugned dated 24.05.1998 is the letter of appointment issued by the Registrar/ Inspector, Arbi Madarsa, U.P., Allahabad address to the Manager, Madarsa, Islamia Jamayatul Quraish, Jalandhari, Azamgarh. This letter of appointment has been challenged by the petitioner.
Since no interim order was passed and the petition is pending since last about 19 years, it appears that by passage of time the same has become infructuous.
It is made clear that none of the counsels are present either of the parties.
The writ petition is dismissed as infructuous.
