Heard learned counsel for the petitioners and learned A.G.A. for the State.
It is submitted by the learned counsel for the petitioners that the dispute between the parties, who are close relatives and which is subject matter of impugned FIR, has been amicably settled between the parties outside the court and the parties have entered into compromise on 23.10.2018 which has been brought on record as (Annexure-3 to the writ petition). In view of the compromise, impugned FIR is liable to be quashed.
Considering the submissions made by the learned counsel for the petitioners, we are of the view that the matter requires consideration.
Notice on behalf of the respondents no.1 to 3 has been accepted by the learned A.G.A.
Issue notice to respondent no.4, returnable within two weeks, directing him to appear before the court on the next date.
List on 19.02.2019.
Learned counsel for the petitioners shall take steps for effecting service on respondent no.4 within two days.
Till the next date of listing, no coercive action shall be taken against the petitioners pursuant to impugned FIR dated 05.10.2018, registered as Case Crime No. 390 of 2018, under Sections 147, 452, 323, 504 I.P.C., P.S.

Copy of this order be issued to the learned counsel for the parties on payment of usual charges today.
