We have gone through the impugned judgment with the assistance of the learned Standing Counsel wherein paragraph no.9 of the impugned judgment categorically states that the age of retirement at 58 years of the employees of NEDA has been upheld in Special Appeal No.851 of 2009 decided on 03.12.2009. From the relief claimed in the writ petition we do not find any challenge having been raised to the validity of the amended Rules.
The only challenge raised is to the communication dated 25.05.2011 informing the appellant to retire at the age of 58 years. A perusal of the short counter affidavit that was filed before the learned Single Judge also brings on record several judgments that have been referred to therein and there does not appear to be any reason for taking a different view from that already expressed. We do not find any merit in this appeal.
The appeal is dismissed.
