Heard Syed Hasan Shaukat Abidi learned counsel for the petitioner and learned AGA for respondent nos.1 to 3.
The petitioners 1 namely Afsana and petitioner no.2 namely Azeen are present in the Court and have been identified by Syed Hasan Shaukat Abidi, learned counsel for the petitioners. They state that they have performed their marriage out of their own free will and want to spend their life together. The respondent no.4 is harassing the petitioner no. 1 and 2.
Considering the documents on record namely the Adhar cards of the petitioners, it appears that the petitioners are major.
The petitioners are apprehending danger to their lives at the hands of the respondent no.4 and hence are seeking police protection and a direction to respondent no.2 and 3 not to arrest the petitioners or create any hindrance in their lives in any manner whatsoever.
In view of the above, the present writ petition is being disposed of with the direction to the respondents 2 and 3 not to harass the petitioners in any manner and further that no other person shall be permitted to interfere in their peaceful living except in accordance with law.
It goes without saying that this Court has not expressed any opinion about the validity of the marriage of the petitioners and genuineness of their marriage certificate issued by Qazi. This order shall not protect the petitioners against any legal action or legal proceedings pursuant to the FIR filed against him/her/them.
