(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) By this application under Article 226 of the Constitution, the petitioner has challenged an order dated July 12, 2011 passed by the Gujarat Pollution Control Board, thereby directing closure of the unit of the petitioner.
In view of the fact that the order is appealable under Section 33B of the Water (Prevention and Control of Pollution) Act, 1974, we are not inclined to entertain this application. This application is dismissed on this ground alone. We make it clear that we have not otherwise gone into the merits of the case and dismissal of the petition will not stand in the way of the petitioner in seeking appropriate remedy before the appropriate forum in accordance with law.
