Heard Sri R.S. Pandey, learned counsel for the petitioner and the learned Standing Counsel for the State-respondents.
The petitioner has preferred this petition for quashing of the notice dated 25.10.2019 issued by Respondent No.2.
It appears from the averments made in the petition that petitioner is the owner of a property which was let out to the respondents for running a primary health centre. The respondents are no longer interested in continuing in the tenancy and as such the Chief Medical Officer has sent a written communication regarding shifting of the primary health centre and vacating the premises let out by the petitioner. The petitioner wants that respondents should not vacate the premises inasmuch as on their promise he contends that he has made investment in the property and constructed several rooms and now he is not in a position to re-pay the loan taken for such construction.
The prayer of the petitioner in this regard is completely misconceived and cannot be accepted for the simple reason that the petitioner cannot compel the tenant to continue with the tenancy.
In view of the aforesaid facts and circumstances, we find no merit in the petition and the same is dismissed.
