Heard Sri Anand Kumar Srivastava, learned counsel for the petitioners, Sri Gautam Baghel, learned counsel for the respondent, Sri Muqeem Ahmad, learned counsel for the respondent No.3, and learned Standing Counsel for the respondent- State.
The petitioners, are aggrieved by the action of the committee of management, rejecting their claim for the membership of the society.
Sri Anand Kumar Srivastava, learned counsel for the petitioners, contends that the petitioner No.4 is the grand son of one of the founding member, and hence, he is entitled to be inducted, as a member of the society.
Sri Gautam Baghel, learned counsel for the respondent, submits that the bye-laws do not provide any concession or reservation in favour of the family of the society. In fact, the society has set its face value against the nepotism, and hereditary rights. Sri Gautam Baghel, learned counsel for the respondent further submits, that the writ petition at the instance of persons, whose application for enrolment as members, were rejected, do not have the locus standi, to maintain the writ petition. He further submits, that the writ petition filed by the other individuals, whose claim for membership of the society was rejected, has been dismissed.
I see merit, in the submission of Sri Gautam Baghel, learned counsel for the respondent. The fate of this case, shall also be governed, by this Court, in the judgement, rendered in Writ-C No.23212 of 2019, (Nadeem Ahmad and others Vs. State of U.P. and others).
The writ petition is dismissed.
