On the case being taken up today for hearing Shri A.K. Pandey, learned counsel for applicants and learned AGA for the State are present.
A Joint affidavit affirmed by opposite party no. 2 Smt. Rekha Shukla and her father-in-law Prem Chand Shukla has been filed today and the same is taken on record.
It is stated in the joint affidavit that parties have resolved their dispute by way of compromise and opposite party no. 2 now does not want to contest the criminal case against the applicants.
Learned counsel appearing for opposite party no. 2 Smt. Rekha Shukla also admits that parties have resolved their dispute by way of compromise and opposite party no.2 now does not want to contest the criminal case against the applicants.
Considering that parties have resolved their dispute out of court by way of compromise and in pursuance thereof opposite party no. 2, Smt. Rekha Shukla does not wish to contest the criminal case against applicants any further, proceedings of the criminal case are liable to be quashed.
Accordingly, application is allowed.
Proceedings of Complaint case no. 1422 of 2013, (Smt. Rekha Shukla vs. Ram Chandra Shukla and others), under section 12 of Domestic Violence Act, Police Station Chakeri, District Kanpur Nagar pending in the court of C.M.M. Kanpur Nagar are quashed.
