Sri Ashok Kumar Singh, Advocate holding brief of Sri Vinod Kumar Rai, learned counsel for appellant and Sri Siraj Ahmad Khan, learned counsel for respondent are present.
As per office report dated 30.7.2019, the Civil Judge (Junior Division), Varanasi has sent a report dated 9.7.2019 that compromise application with regard to compromise entered into between the parties during Second Appeal No.1373 of 1992, was sent to Trial Court for verification, and has been verified by it in presence of parties, who were duly identified by their respective counsel.
It is also reported that vide letter dated 1.8.2018 the Civil Judge (Junior Division), Varanasi has returned the duly verified compromise application to this Court, which is on record.
Since parties have entered into compromise, which has been duly verified by Trial Court, hence appeal is liable to be decided in terms of compromise.
The appeal is therefore disposed of accordingly in terms of compromise, which shall form part of decree.
Interim order, if any, stands vacated.
After preparation of decree, lower court record be sent back to Court below along with a copy of this judgment for necessary action, if any.
