Mr. Sabyasachi Ghosh I.A.S., Director, Tourism Department, Government of Andhra Pradesh, Secretariat Road, Hyderabad Respondents/Respondents WHEREAS your attendance is necessary to answer the charge of the Contempt of Court under Sections 10 to 12 of Contempt of Courts Act viz; punish the respondents herein for willful disobedience of orders of this Hon`ble Court dated: 06-08-2009 in WPMP No. 21098 of 2009 in WP No. 16079 of 2009;
You namely;
1. Mr. Jayesh Ranjan, I.A.S., Secretary to the Government of Andhra Pradesh, Youth Advancement, Tourism & Culture (T) Dept. Secretariat Buildings, Saifabad, Hyderabad.
2. Mr. Sabyasachi Ghosh I.A.S., Director, Tourism Department, Government of Andhra Pradesh, Secretariat Road, Hyderabad are hereby required to appear in person before the High Court of Andhra Pradesh at Hyderabad on 06-06-2014 at 10. 30 a.m and show cause as to why you shall not be punished or other appropriate order be not passed against you for Contempt of the High Court of Andhra Pradesh.
You shall attend High Court of Andhra Pradesh at Hyderabad in person on 06-06- 2014 at 10. 30 a.m and shall continue to attend the High Court on all days thereafter to which date the case against you stands adjourned and until final orders are passed on the charge against you.
Herein fail not.
And the Court further made the following ORDER:
“The Contempt Case was filed seeking non-implementation of the order dated: 06-08-2009 and when it was posted on 11-11-2011, the learned counsel representing the respondents took time and after two adjournments, on 16-12-2011 the learned ..2..
Government Pleader stated that steps are being taken to issue appropriate orders in compliance with the directions of the Court. Accordingly, the matter was posted to 06-01-2012, on which date a representation was made on behalf of the respondents stating that revised certificate was issued to the petitioner and the petitioner denied the receipt of the same. The case was directed to be posted after Sankranthi Vacation and in the meanwhile the learned Government Pleader was directed to furnish a copy of the revised certificate to the learned counsel for the petitioner. The learned counsel for the petitioner states that he has not received any certificate. Thereafter, when the matter was listed on 18-03-2014, the learned Government Pleader was absent and it is posted to today along with the main Writ Petition. Today, in the Forenoon the learned Government Pleader did not make a representation and sought adjournment after lunch. After lunch a representation is made asking for an adjournment to after Summer-2014 vacation. Though a counter-affidavit is filed in the year 2011 stating that the recommendations made by the Committee of Officers were approved by the State Tourism Promotion Committee headed by the Chief Secretary to Government in the meeting held on 13-06-2011 and those recommendations have been circulated for placing before the State Tourism Promotion Board headed by the Hon`ble Chief Minister for approval and the benefits would be extended to the petitioner soon after approval by the State Tourism Board. Even after two (2) years, no orders have been passed in respect of the petitioner pursuant to the orders of this Court.
In the circumstances, ADMIT the Contempt Case. Issue Form-I Notice.
Post the Contempt Case for appearance on 06-06-2014”.
