The present application has been filed with a prayer to direct the Court below to expedite and conclude the trial in Session Trial No.1150/2009 (State Vs. Purshottam Sahu and others) arising out of Case Crime No. 265/2009, Police Station Barra, District Kanpur Nagar pending in the court of Additional District and Session Judge XIVth Kanpur Nagar, under Sections 302, 307, 120-B, 506 I.P.C.
Only prayer made by the applicant is to expedite the trial. It is contended that the case is pending since, 2009 and there are 19 witnesses, out of which 10 witnesses have been examined by the prosecution. The proceedings are lingering since 2009.
In the facts and circumstances of the case, the present application is disposed of with a direction that in case the applicant files an application for expediting and concluding the trial before the concerned court below along with certified copy of this order, the concerned court below shall make every endeavour to expedite and conclude the aforesaid trial, as expeditiously as possible, preferably within a period of six month from the date of filing of such application without granting unnecessary adjournment to either of the parties, provided the proceedings are not stayed by any court of law.
