Heard learned counsel for the petitioner and learned Standing Counsel and Sri Sunil Kumar Singh, learned counsel appearing for the Gaon Sabha.
Present petition has been filed for quashing the impugned proceeding in case no. 02899/ 2021 under Section 38 (2) of U.P. Revenue Code, 2006 State Vs. Munni Devi and others (Annexure No. 5 & 6 to the petition).
The petitioner is challenging the proceedings on various grounds and by referring to various dates and orders passed by the authority concerned previously.
A perusal of the report submitted by the Lekhpal indicates that all such records have been considered and thereafter a report has been submitted.
In such view of the matter, I am not inclined to entertain any arguments on merits as all such facts can be raised by the petitioner before the authority concerned in the pending proceedings.
Accordingly, present petition stands disposed of with liberty to the petitioner to file his objections and take all such grounds that are being taken before this Court in the present case before the authority concerned.
In case, the objections are filed by the petitioner within a period of 15 days from today, the same shall be considered and decided by the authority concerned by way of passing a reasoned and speaking order preferably within a period of three months from the date of production of self- attested copy of this order, which may be verified from the official website of this Court.
