O.P. No. 395/2007 on the file of the Court of the District Judge of Thrissur is one filed to frame a scheme to the society under Section 25 of the Travancore - Cochin Literary Scientific & Charitable Societies Registration Act, 1955.
2. The petitioners are petitioner nos. 1 and 2 in O.P. No.
395/2007 and they filed I.A. No. 3895/2010 to delete them from party array. There was also a prayer in I.A. No. 3895/2010 to permit them to represent the first respondent society in the proceedings.
3. There can be no objection in deleting the petitioners from O.P. No. 395/2007 as sought in I.A. No. 3895/2010 and the same is allowed. But the question whether the petitioners can represent the first respondent society in the proceedings is a matter for consideration at the time of trial. That issue is left open to be considered in O.P. No. 395/2007 by the Court of the District Judge of Thrissur at the earliest. Every endeavour shall O.P.(C) No. 2025 of 2013 2 be made to take the proceedings to a logical end within a period of four months from the date of production of this judgment.
4. I.A. No. 3895/2010 in O.P. No. 395/2007 is allowed in part and Ext. P2 order impugned in this Original Petition is modified.
The Original Petition is disposed of.
