Heard Sri Mohit Kumar, learned counsel for the applicants and Sri Abhinav Prasad, learned A.G.A. for the State.
Present application has been filed seeking a suitable direction to the Metropolitan Magistrate-1, Kanpur Nagar to consider and conclude the Case No. 39600 of 2018 (State Vs. Adhar Gupta and Another) in Charge sheet No. 24/18 dated 07.05.2018 arising out of Case Crime No. 0018 of 2017, under section 498A, 323, 504, 506 IPC and 3/4 Dowry Prohibition Act, Police Station Mahila Thana, District Kanpur Nagar, pending in the court of Metropolitan Magistrate-I, Kanpur Nagar, expeditiously, preferably within the time stipulated by this Court.
After hearing the learned counsel for the applicant, learned A.G.A. and after perusing the material on record, no useful purpose would be served in keeping the petition pending which is finally disposed off with a direction to the Metropolitan Magistrate-1, Kanpur Nagar to consider and conclude the Case No. 39600 of 2018 (State Vs. Adhar Gupta and Another) in Charge sheet No. 24/18 dated 07.05.2018 arising out of Case Crime No. 0018 of 2017, under section 498A, 323, 504, 506 IPC and 3/4 Dowry Prohibition Act, Police Station Mahila Thana, District Kanpur Nagar, pending in the court of Metropolitan Magistrate-I, Kanpur Nagar, most expeditiously, if already not decided, strictly in accordance with law, after hearing the parties and without granting any unnecessary adjournment to either the parties, preferably within a period of six months from the date of production of a certified copy of this order before him, provided the proceedings are not stayed by any Court of law.
