A.Dhamodharan vs Minor Narmadha

Madras High Court|12 January, 2017

JUDGMENT / ORDER

This revision arises against the order of learned Chief Judicial Magistrate, Family Court, Tiruppur, passed in M.C.No.36 of 2013 on 26.05.2016.
2. Petitioner and second respondent are husband and wife. First respondent is their minor daughter. Respondents moved M.C.No.36 of 2013 on the file of learned Chief Judicial Magistrate, Family Court, Tiruppur, seeking maintenance. Court below, under the impugned order, directed the petitioner to effect payment of sums of Rs.5,000/- and Rs.3,000/- p.m. to respondents respectively towards maintenance. Aggrieved, petitioner has preferred this revision.
3. Heard learned counsel for petitioner.
4. In directing payment of maintenance, the Court below has taken a reasoned approach and considering the present rise in prices, educational and medical expenses, granted maintenance only in a minimal and nominal amount taking into consideration the duty of petitioner to maintain the respondents/his wife and minor daughter. This Court finds no reason to interfere with the order of Court below.
The Criminal Revision Case shall stand dismissed. Connected miscellaneous petition is closed. 12.01.2017 Index:yes/no Internet:yes/no gm To The Chief Judicial Magistrate, Family Court, Tiruppur.
