HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.7190 of 2014 ORDER:
Aggrieved by the inaction of respondents to pay the enhanced compensation in pursuant to the judgment, dated 05.08.2002, in L.A.O.P.No.933 of 2001, on the file of the District Judge, Kadapa, Y.S.R. Kadapa District, which attained finality consequent to disposal of S.L.P. in the year 2011, this writ petition is instituted.

Learned counsel for the petitioners submits that even though the enhancement was granted as early as in August, 2002 and even though the S.L.P. was dismissed in the year 2011, till date the enhanced compensation is not paid and the petitioners are running from pillar to post and compelled to institute this writ petition. Learned counsel for the petitioners further submits that only in pursuant to directions of this Court, the enhanced compensation is paid to persons who approach this Court. Learned counsel for the petitioner places reliance on earlier decision of this Court in W.P.No.22619 of 2012, who are similarly situated and in whose favour, the enhanced compensation was paid pursuant to the directions of this Court. In the said case, when the matter was taken up for consideration, the learned Assistant Government Pleader for Land Acquisition represented that within three (3) months, the enhanced compensation would be paid. Recording the same, the writ petition was disposed of. Pursuant to the undertaking in the above writ petition, the enhanced compensation amount was paid to the petitioners therein, but no such amount is paid to the petitioners.

It is very unfortunate that in spite of the enhancement granted to the land losers as early as in the year 2002 and the appeals filed by the respondent Government having become final in the year 2011, the enhanced compensation amount is not paid. The persons are driven to Court and the amounts to which persons are legally entitled are not paid unless writ petitions are filed. The said attitude of the respondent Government is highly deprecated.

The Writ Petition is disposed of directing the respondent Government to settle the enhanced compensation and all consequential benefits payable to all persons who are entitled to receive enhanced compensation in terms of orders of the Principal District Judge, Kadapa, Y.S.R. Kadapa District, in L.A.O.P.No.933 of 2001, including these petitioners within a period of three (3) months from the date of receipt of copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
