Heard learned counsel for the parties.
Brief facts of the case are that State Government has decided to fill up 68500 vacancies of Assistant Teachers in Primary Schools run by U.P. Basic Shiksha Parishad, Allahabad and for that purpose vide letter dated 9.1.2018, State Government has directed Secretary Examination Regulatory Authority, U.P. Allahabad (hereinafter referred to as "Secretary") to conduct the Assistant Teachers Recruitment Examination, 2018 (hereinafter referred to as 'Examination 2018).
In the present petition, the petitioner has prayed for the following relief:-
"1. A writ, order or direction in the nature of mandamus directing the respondents to produce original answer key (Answer Copy) of Booklet Series D of the petitioner before this Hon'ble Court and the same may be duly compared and marked be allotted as stated by the petitioner.
2. A writ, order or direction in the nature of mandamus commanding to the respondents to calculate marks against question No.46, 59, 100, 101, 122 and declare the result of the petitioner of Assistant Teachers Recruitment Examination 2018.
3. A writ, order or direction in the nature of mandamus to directing the respondents to issue appointment letter in favour of the petitioner after being found illegible and qualified in Assistant Teachers Recruitment Examination 2018 and also provided all other consquential benefits as given to other qualified and selected candidates.
4. To issue a writ, order or direction that this Court may deem fit and proper under the facts and circumstances of the case.
5. To award the cost of this petition to the petitioner."
Learned Standing Counsel submits that the last date for submitting the application for revaluation was 21.11.2019. As much as a last opportunity given by this Court in Writ - A No. 6420 of 2019, to eligible candidates to apply for revaluation within a period of one month. Thus, the submission is that since the petitioner has not applied within the time prescribed by this Court in Writ - A No. 6420 of 2019, therefore, the prayer sought by the petitioner may not be granted.
Be that as it may, this Court while deciding Writ - A No. 6420 of 2019, granted one month's time to submit the application in the Office of Secretary for revaluation of the answer-sheet.
Admittedly, the petitioner has not applied till date for revaluation.
In view of the fact that the time limit prescribed by this Court has expired, the petitioner cannot be allowed to apply for revaluation.
The writ petition stands dismissed.
