Since learned advocate Mr. Raval appears on behalf of the respondents, original claimants, let these appeals be treated as ready for final hearing. Learned advocate for the appellants is directed to prepare six informal sets of paper book containing all relevant papers and serve a copy thereof on the learned advocate for the appellants within four weeks from today. Let the appeals be listed for hearing on February 10, 2012.
CIVIL APPLICATION Nos. 70 of 2012 To 80 of 2012 Learned advocate appearing on behalf of the respondents, original claimants, submits that appellants had deposited the entire amount awarded by the Reference Court, and in the absence of any stay after passing of the award impugned, his clients have already withdrawn 50% of the amount deposited by the appellants.
In such circumstances, we dispose of these applications by directing the court below not to release the balance 50% in favour of the claimants. Let the balance amount be kept in a short term deposit in any nationalized bank until further orders, if not already deposited.
It is needless to mention that withdrawal already made will abide by the final order that will be passed in the appeal.
The Civil Applications stand disposed of accordingly.
