3. Smt.Uma Maheswari W/o late M.Paranjothi (R3 substituted in the place of the deceased R1 vide order of Court dt.16.12.14 made in M.P.No.1 of 2013 in W.P.No.1495 of 2012) .. Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Certiorari, calling for the records relating to the order dated 29.03.2011 passed in O.A.No.1174 of 2010 on the file of the Central Administrative Tribunal Chennai and to quash the same.

2. The issue raised in this writ petition is whether the widows of Central Government Pensioners getting family pension are eligible to be the members of the Central Government Health Scheme (CGHS). According to the communication issued by the Additional Director, Central Government Health Scheme, Chennai dated 27.7.2017, as produced by the learned Senior Panel Counsel for Central Government, the widows of Central Government pensioners getting family pension are eligible to be the members of the scheme. In the case on hand, the third respondent, being the wife of the deceased first respondent, if in receipt of family pension, is eligible to avail the medical facilities under the Central Government Health Scheme, even though the latest OM dated 19.7.2017 is silent. Accordingly, placing on record the aforesaid communication issued by the Additional Director of Central Government Health Scheme, Chennai, we dispose of this writ petition. Consequently, M.P.No.1 of 2012 is closed. No costs.
