ORDER:
This writ petition is filed for a mandamus to declare the action of respondent Nos.2 and 3 in not allotting essential commodities to the petitioner for distribution through fair price shop No.36 of Chandaluru Village, Darsi Mandal, Prakasam District as illegal and arbitrary.
The petitioner averred that following inspection taken place on 14.10.2014, respondent Nos.2 and 3 have withheld stocks.
At the hearing, the learned Assistant Government Pleader for Civil Supplies (AP) appearing for the respondents, on instructions, submitted that as the petitioner has not produced the demand drafts, stocks have not been released and that if and when the petitioner produces the demand drafts, stocks will be allotted. He is, however, unable to state as to any order allotting stocks was issued by respondent No.3. Unless such an order is issued, the petitioner will not be in a position to know the amount for which the demand draft has to be obtained. Therefore, while not accepting the version of respondent No.3 as true, he is directed to forthwith issue stock allotment order to the petitioner and release the stock on production of demand drafts by the petitioner.
Subject to the above direction, the writ petition is allowed.
As a sequel to disposal of the writ petition, W.P.M.P.No.49407 of 2014 shall stand disposed of as infructuous.
