Respondents THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.13854 OF 2013 O R D E R The petitioner Toddy Tappers Co-operative Society approached this Court by way of the present writ petition seeking a declaration that the proposal of the respondent authorities to permit new toddy shops in Gundlamadugu and Kottaluru villages within two kilo metres of the petitioner’s toddy shop and to include new tappers in the petitioner society was illegal.
2. The Prohibition and Excise Superintendent, Chittoor, the 3rd respondent, filed a counter-affidavit stating that the authorities did not propose to establish any shop within a distance of two kilo metres from the petitioner’s shop and that the inclusion of new members in the petitioner society was purely an internal matter and that the authorities have no concern with the same.
2. In the light of the stand taken by the respondent authorities, it is clear that the apprehension of the petitioner society is without basis.
The writ petitioner is accordingly dismissed. W.P.M.P. No.16944 of 2013 shall stand dismissed in consequence. No costs.
