It appears on plain looking of the impugned judgment and order that His Lordship has not practically decided anything else except taking note of the factual submission that there has been no construction in the tot-lot area earmarked in the sanctioned plan.
The learned Senior Advocate Sri A. Satya Prasad, appearing for the appellant, says that the submission made on factual basis before the Hon’ble Single Judge is correct.
In view of the aforesaid position and when there is no construction factually, apprehension as demonstrated before us is wholly baseless. We, therefore do not interfere with the judgment and order of the Hon’ble Single Judge. The interim order passed by this Court earlier stands vacated.
The writ appeal is accordingly dismissed. There will be no order as to costs.
Consequently, pending miscellaneous petitions, if any, shall also stand dismissed.
