O R D E R:
W.P.No.21912 of 2009 was disposed of by this Court on 10.03.2014 after hearing all the parties and considering the order dated 27.07.2005 in W.P. No.16506 of 2005 and a direction was given to the 2nd respondent therein to inspect the premises covered by B.A.No.678/00 dated 10.07.2000 in Survey No.33/6 of T.P.No.43/1963 of Allipuram Extension Ward, Santhipuram, Visakhapatnam, as per the sanctioned plan and if any unauthorized constructions are found to have been made, the 2nd respondent was given liberty to take action in accordance with law.
2. It appears that the present proceedings were issued on 25.03.2014 under Section 452 (2) of the Hyderabad Municipal Corporation Act, 1955, pursuant to the said directions and after inspection of the premises. The directions in W.P. No.16506 of 2005 were merged in the order dated 10.03.2014 in W.P. No.21912 of 2009. In the circumstances, it cannot be said that the respondent committed contempt of the order dated 27.07.2005 in W.P.No.16506 of 2005.
3. The contempt case is accordingly dismissed. No costs.
