Though the endorsement on the Board indicates that notice issued to respondent No.3 has not been received back, either served or unserved, it is stated by Ms.Paurami B.Sheth, learned advocate for the plaintiff, that a Purshis has been filed by the plaintiff to the effect that the packet of notice has been sent vide Fast to Fast Courier under Airway Bill No.001628 to defendant No.3 at the address and as informed by the Courier Company by letter dated 09.03.2010, the packet has been dropped in the Post Box on 13.02.2010. The learned advocate for the plaintiff prays for a short adjournment.
