(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) The present application is filed by the convict through jail seeking temporary bail for a period of 30 days so as to undertake religious ceremony after the birth of his son on 16.6.2012. The Birth Certificate of the son is enclosed and also for the treatment of his wife.
The jail remarks are on record.
The convict is undergoing 7 years imprisonment for an offence under Section 307 of Indian Penal Code in Sessions Case No.237 of 2009; wherein, he was convicted by judgment and order dated 21.7.2011.
By now, he has undergone, 2 years, 11 months and 6 days as on 5.7.2012.
He has enjoyed 1 furlough leave in the month of November, 2011.
Besides, the applicant has produced medical papers showing the treatment taken by his wife.
For the contents of the application, the application is allowed. The convict is ordered to be released on temporary bail for a period of 20 days from the date of his release on his executing a personal bond of Rs.5,000/- (Rupees Five Thousand Only) to the satisfaction of the Jail authorities.
The convict shall surrender himself to the Jail authorities on expiry of the above temporary bail period. The application is allowed.
