Adaikalasamy vs State Rep.By The Commissioner Of

Madras High Court|23 June, 2017

JUDGMENT / ORDER

(Order of the Court was made by NOOTY.RAMAMOHANA RAO,J) This writ petition is instituted for causing production of a 26 year old son of the writ petitioner.
2. The facts, as emerged from the affidavit filed in support of this writ petition, disclose that the writ petitioner's son, who was working in DSRC Data Software Research Centre, Anna Salai, Chennai, went missing from 11.5.2017 onwards and in spite of a complaint lodged by the petitioner on 15.5.2017 with the Police at Saidapet, no action has been taken in that regard. It is also alleged in the affidavit that the father of the girl Vishvapriya, with whom, it is alleged that his son ran away, was making calls over cellphone threatening him of dire consequences.
3. In the given situation, we felt it appropriate to interact with the Deputy Commissioner of Police concerned. As desired by us, Sri.Sundaravadivel, Deputy Commissioner of Police, Adyar District appeared today in the Court. We had a useful round of interaction with him. Along with the Deputy Commissioner of Police, Sri.K.Vijayakumar, Inspector of Police, J1 Saidapet Police Station was also present in the Court. He caused the production of 26 year old son of the writ petitioner by name Anis Alexander and also 25 year old girl Vishvapriya.
4. We have interacted separately with both of them. They both informed us that they married each other on 11.5.2017. Since the above petition is not the appropriate proceedings for us to either recognize the status or to deal with that, we do not wish to make any further order. It is open to the respective parties to work out the remedies available to them under the law. But, however, since the two individuals have already attained the age of majority and since they were educated and also articulate to express their views very freely, we consider that no further orders are needed to be passed in this writ petition, as both the individuals referred to supra, contrary to the apprehensions entertained by the writ petitioner, are freely moving in the society.
5. Hence, the above Habeas Corpus Petition is closed.
