Heard learned counsel for the petitioner and perused the record.
In view of the order proposed to be passed, notices need not issue to the respondents.
The petitioner is before this Court for a direction to the Civil Judge (Junior Division), Gorakhpur to decide the Application 19Ga under Order-1 Rule-10 of C.P.C. and Application 21Ga under Order-7 Rule 11 of C.P.C. filed in Original Suit No. 2004 of 2019 (Krishna Bihari & Others Vs. Adnaan Farookh) within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the Civil Judge (Junior Division) Gorakhpur to consider and decide the aforesaid applications in accordance with law expeditiously and preferably within a period of four months from the date of production of copy of this order but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
