(Per : HONOURABLE THE CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) This matter has been mentioned by Ms. Shah appearing on behalf of the petitioners in the Writ Petition (PIL) No.100 of 2011 pointing out that in connection with the Civil Application No.5630 of 2012 in the Writ Petition (PIL) No.100 of 2011, this Court, by order dated 3rd August, 2012, directed that the matter should appear on 24th August, 2012 and interim relief, modified on 19th July, 2012, to continue until further orders. She points out that in the subsequent order dated 13th September, 2012, it appears that the interim relief, modified on 19th July, 2012, has been recorded to be extended till 20th September, 2012, but in fact, no such order was passed nor was there any occasion for further extending the order, because, by earlier order dated 3rd August, 2012, the interim order had been extended until further orders. She points out that in the subsequent orders dated 20th September, 2012, 27th September, 2012, 4th October, 2012 and 11th October, 2012, the same mistake is continuing, and on each date, the interim order has been extended till next date. She further points out that in the connected matter being Writ Petition (PIL) No.168 of 2012, there was no separate interim order passed, but there also, the interim order has been extended till next date, as it appears from the order dated 18th October, 2012 and 1st November, 2011, although, there is no initial interim relief granted in that matter.
From the above position, it is apparent that through mistake, the interim order, earlier granted on 3rd August, 2012 until further order, has been wrongly extended only till next dates. We therefore, rectify those mistakes by recording that the interim order dated 3rd August, 2012, passed in Civil Application No.5630 of 2012 in connection with the Writ Petition (PIL) No.100 of 2011, as modified on 19th July, 2012, will continue until further orders.
