(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) Pursuant to the order dated 3.7.2012 passed by this Court, office has placed office note dated 10.7.2012 before Hon'ble the Chief Justice. However, it appears that office has not pointed out either in A, B or C that where vires of any Act is challenged, such matters are to be heard by Division Bench presided by Hon'ble the Chief Justice as per the present roster.
Office is, therefore, directed to prepare clear note and place it before Hon'ble the Chief Justice clearly pointing out that in the present petition, vires of Section 32 F(6) of the Central Excise Act, 1944 is under challenge. We may also like to clarify that such mistake shall not be repeated by the office in future. Office is directed to obtain necessary nomination from Hon'ble the Chief Justice.
