[Order of the Court was made by M.SATHYANARAYANAN] It is brought to the knowledge of this Court that the 3rd respondent in the writ petition [WP.No.4833/2013], viz., V.Shanmugam, filed a revision before the Director of Town and Country Planning, Chennai-2, and it was dismissed and aggrieved by the same, he filed a Special Revision under section 80-A of the Town and Country Planning Act, 1971, before the Secretary to Government, Housing and Urban Development Department, Fort St George, Chennai-600 009 and the same is pending.
2 The learned counsel for the petitioner would submit that the Appellate Authority may also put the petitioner herein and give a disposal of the revision in accordance with law.
3 The Court heard the submissions of Mr.A.N.Thambidurai, learned Special Government Pleader appearing for the respondents and perused the materials placed before it.
4 Accordingly, the Secretary to Government, Government of Tamil Nadu, Housing and Urban Development Department, Fort St. George, Secretariat, Chennai-600009, is directed to put the petitioner on notice also and thereafter, dispose of the special revision petition filed by the 3rd respondent in WP.No.4833/2013 on merits and in accordance with law and pass appropriate orders as expeditiously as possible and communicate the decision taken, to the 3rd respondent and the writ petitioner.
5 In the result, the contempt petition is closed subject to the above observation and direction.
