Heard learned counsel for the applicants and learned A.G.A. for the State.
From the perusal of the record it transpires that this application has been filed against the impugned order dated 24.12.2001 wherein the opposite party no. 2 and 3 who are father and mother of applicants respectively have been awarded Rs. 100/- each as maintenance from their sons who are applicants in the present case.
Learned A.G.A. for the State submitted that this application has been filed in the year 2002, it appears that by efflux of time the relief sought by the applicants has become infructuous. Further submitted that in the present case learned counsel for the opposite parties is not present.
Accordingly, this application stands dismissed as likely to be infructuous.
However, in case the cause of action still survives, the applicants are at liberty to approach the Court by filing recall/restoration or any other remedy available under the law and procedure.
