Heard Sri Rajendra Prasad Yadav, learned counsel for the petitioner, Sri M.K. Yadav, learned counsel for the respondent no.5 and the learned Standing Counsel for the respondents no. 1 to 4.
The petitioner in the writ petition is seeking a direction to the respondents to remove the illegal encroachment of the respondent no. 6 over Gata no. 72 area 0.7160 hectare, Gata no. 89 area 0.1460 hectare, Gata no. 95 area 0.1280 hectare, which are recorded as pond, Gata no. 84 area 0.0110 hectare, Gata no. 119 area 0.0250 hectare, which are recorded as Sauri place and Khasra no. 275 area 0.3110 hectare, which is recorded as Kabristan in the revenue record situated in Village Jangipur, Tehsil Saidpur, District Ghazipur. The relevant extract of the revenue record has been filed as Annexure-1 to the writ petition.
No useful purpose would be served in keeping the petition pending.
This writ petition is, therefore, disposed of with a direction to the respondent no.4-Tehsildar, Tehsil Saidpur, District Ghazipur to enquire into the matter and take appropriate action, in accordance with law within a period of two months from the date of receipt of a certified copy of this order in his office.
It is made clear that the court has not adjudicated the claim of the petitioner on merit.
