JUDGMENT / ORDER

1.0 By way of present petition, the petitioner has challenged the order dated 04.07.2012 passed by the Gujarat Co-operative Society Tribunal, Ahmedabad in Revision application No. 69 of 2012 whereby the Tribunal has dismissed the Revision of the present petitioner confirming the order dated 02.03.2012 below Exh. 5 passed by the Board of Nominee in Lavad Case No. 35 of 2012.
2.0 On hearing, prima facie it appears that the issues raised by the petitioner require serious consideration. However, admission of the petition will not help the petitioner. Instead of that, with a view to avoid further delay, it is directed that if the petitioner moves an application for counter claim and counter injunction, the same will be considered and decided by the learned Board of Nominee within a period of three months from the date of receiving the application for counter claim and counter injunction application, in accordance with law..
3.0 It is clarified that this Court has not decided the matter on merits and the Board of Nominees will decide the counter injunction application to be filed by the petitioner herein without being influenced by the earlier orders of Board of Nominees and Tribunal and also of this Court.
4.0 With the above direction, this petition stands disposed.
