Perused the report of the learned Civil Judge (Senior Division)/FTC, Kanpur Nagar. The report shows that there is some kind of an application for appointment of a commission under Order XXVI Rule 9 C.P.C. that is pending, to which objections have been invited by the Trial Judge.
Mr. Ved Kant Mishra put in appearance on behalf of the defendant-respondent.
Since both parties are present, upon perusal of the totality of circumstances and the nature of the relief sought, this Court is of opinion that the Trial Court ought to decide the suit expeditiously. It should be the approach of the Trial Court to get past interlocutory matters as swiftly as may and set down the suit for trial as early as possible.
The learned counsel for the defendant-respondent states that written statement has already been filed.
The Trial Court shall proceed to frame issues within a month and shall thereafter set down the suit for trial. The Court shall endeavour to conclude the trial within six months of the commencement of hearing.
This petition is disposed of in terms of the aforesaid order.
Let this order be communicated to the learned Civil Judge (Senior Division)/FTC, Kanpur Nagar through the learned District Judge, Kanpur Nagar by the Registrar (Compliance) within 24 hours.
