The petitioner claims to be the owner and in possession of 28 Ares and 50 Sq.metres of property comprised in Survey No.285/1-1 of Thrikkakara Village, Kanayannur Taluk. The petitioner’s case is that by mistake, this property is shown as Government Puramboke in Survey No.596/3 Part. The petitioner has approached the Land Revenue Commissioner and also other respondents for correcting the re-survey records. On account of non-consideration of the petitioner’s request, the petitioner has approached this Court.
2. The petitioner has an alternate remedy under Section 13 A of the Kerala Survey and Boundaries Act, 1961 (for short, the ‘Act’) to approach the District Collector by way of revision. Therefore, the petitioner shall approach the W.P.(C) No.28693 of 2014 2 District Collector, Ernakulam under Section 13A of Act. If the petitioner files any such revision within two weeks from the date of receipt of a copy of this judgment, the District Collector shall advert to the revision within a further period of two months after hearing the petitioner and pass appropriate orders thereon.
The writ petition is disposed of as above.
