The limited prayer in this original petition is for a direction for an early disposal of A.S. No.198 of 2012 pending before the Additional District Court -I, Mavelikara. 2. The petitioner points out that, he is the plaintiff in O.S. No.66 of 2011 of Sub Court, Chengannur, which was one for recovery of possession and obtained decree in his favour. The Bank has gone up in appeal. The appeal is of the year 2012. In spite of several postings, the appeal is not being heard and court concerned goes on adjourning the same without any reason. Petitioner also points out that, he is advanced in age and he would like to have the matter heard at the earliest.
3. Considering the nature of grievance that is agitated and also the fact that the petitioner is advanced in age, O.P.(C) No. 2343 of 2014 (P) 2 it is felt proper for this Court to direct the court below to dispose of the appeal.
In the result, this petition is allowed. There will be a direction to the Additional District Court-I, Mavelikara to take up A.S. No.198 of 2012, at the earliest and dispose it of, after hearing both the sides, at any rate, within a period of 'three months' from the date of receipt of a copy of this judgment.
