The petitioner applied for temporary permit on the route Madathara - Vilakkupara in the vacancy of defaulted service bearing No.KL-16D-5040. The petitioner has approached this Court with a prayer to direct the respondent to grant and issue temporary permit to the petitioner's stage carriage on the aforesaid route in the vacant timings of stage carriage bearing KL-16D-5040, by considering Ext.P1 application. 2.If vacancy of stage carriage bearing registration No.KL-16D-5040 is still in existence and if no other person has applied for a temporary permit to operate a stage carriage in that vacancy, there will be a direction to the respondent to issue a temporary permit of four months duration within three weeks from the date of production of a copy of this judgment by passing appropriate orders on Ext.P1. Needless to say, such W.P.(C) No. 29698 of 2014 (J) 2 issuance of temporary permit will be subject to the preferential claim, if any.
Writ petition is disposed of as above.
